Who these terms apply to

These Terms of Service apply whenever you access or use Schpin, including its iPhone app, website, APIs, maps, feeds, route journal, sharing tools and related services (together, the “Service”). “Schpin”, “we”, “us” and “our” mean the operator of the Service identified in the applicable App Store listing and at schpin.app. You can contact us at support@schpin.app.

By creating an account or using the Service, you agree to these terms and acknowledge the Privacy Policy, Security Policy, Safety Centre and Disclaimers. If you do not agree, do not use the Service.

Eligibility and authority

You must be at least 16 years old to hold a Schpin account. If the law where you live requires a higher age to consent to online services, you must meet that higher age or have valid permission from a parent or guardian.

You may record a journey as its driver only if you are legally entitled to drive that vehicle and hold every licence, permission, insurance, registration, tax and other authorisation required in the places where you drive. If you use Schpin for an organisation, you confirm that you have authority to bind it to these terms.

Safety is your responsibility

You are solely responsible for controlling your vehicle, observing the road, choosing a lawful route, protecting passengers and other road users, and deciding whether it is safe to continue. Schpin does not control your vehicle and must never replace your judgement, official signs, police directions, approved navigation or the rules of the road.

Never hold, read, adjust or otherwise interact with a phone while driving where doing so is unsafe or unlawful. Configure the app before moving. A passenger may handle permitted interactions, or the driver must stop and park somewhere safe and legal first. Do not stop on a motorway shoulder or another prohibited or dangerous location merely to use Schpin.

Strictly prohibited driving conduct

You must not use Schpin to plan, facilitate, record for promotion, celebrate, request, encourage or participate in:

• speeding, street racing, time trials, drifting, dangerous, careless, inconsiderate or impaired driving;
• competitive attempts to set a fastest time, highest speed or other road-performance record;
• trespass, unlawful off-road driving, road obstruction, evasion of police or interference with emergency services;
• driving through closures, restricted roads, private land, floodwater or conditions unsuitable for you or your vehicle;
• harassment, surveillance, stalking or disclosure of another person’s location without a lawful basis; or
• any conduct that breaches transport, mobile-device, vehicle, insurance, environmental or other applicable law.

We may remove content, limit features, preserve relevant records, suspend accounts or report credible threats or suspected unlawful conduct where reasonably necessary and lawful.

Accounts and security

Provide accurate information, keep access to your app account secure and do not share it. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care. Tell us promptly if you suspect unauthorised access.

You may not impersonate another person, create deceptive accounts, evade a suspension, sell or transfer an account, scrape the Service, probe its security, introduce malicious code, overload its infrastructure or access it through unauthorised automation.

Location, GPS and drive metrics

Schpin records location only for features you choose to use and subject to device permissions. GPS, motion sensors, network conditions, map data and device hardware can produce missing, delayed or inaccurate points. Distance, speed, duration, elevation, route shape, heat maps and other metrics are estimates, not certified measurements.

Metrics are provided for personal journalling and context. They are not proof of your speed, location, compliance, driving ability or responsibility; they are not suitable for insurance, employment, legal, evidential, emergency or safety-critical decisions. Never treat a displayed speed or metric as permission to exceed a legal or safe speed.

Shared Schpins and passengers

The original recorder controls the source activity. Adding passengers or participants does not transfer responsibility for the drive and does not prove who was driving or present. Before adding someone, you must have a reasonable basis to identify them and permission to associate them with the journey.

Participants may receive or display the shared activity according to their settings. Do not add people deceptively, expose another person’s movements, or use shared activities to allege misconduct. We may limit participant numbers, invitations or visibility to protect privacy and service integrity.

Your content and licence to us

You retain ownership of route titles, comments, images and other content you create. You confirm that you have the rights and permissions needed to upload and share it and that doing so does not infringe privacy, confidentiality, intellectual property or other rights.

You grant Schpin a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical formatting, transmit and display your content solely to operate, secure, improve and promote the Service in line with your audience settings. This licence ends when the content is deleted, except for reasonable backups, legal retention, content already shared by others, and materials for which continued processing is otherwise permitted by law.

Community standards

Do not post content that is unlawful, threatening, abusive, discriminatory, sexually exploitative, deceptive, privacy-invasive, dangerous, spam, malware, or an infringement of another person’s rights. Do not glorify collisions, reckless driving, speeding or illegal vehicle use.

We may use automated and human review, respond to reports, restrict visibility, remove content, disable features or suspend accounts. Moderation decisions involve judgement and cannot guarantee that every objectionable item will be detected immediately. Use available report and block tools and contact support@schpin.app for urgent safety or abuse concerns. Schpin is not an emergency service.

Our intellectual property

The Service, Schpin name, wordmark, interface, software, design, databases and original materials are owned by or licensed to us and protected by law. Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and website for their intended non-commercial purpose.

You may not copy, modify, sell, sublicense, reverse engineer, extract datasets from, create derivative services from, or commercially exploit Schpin except where applicable law expressly permits an act that cannot be restricted by contract.

Maps and third-party services

Schpin may use mapping, authentication, hosting, notification, analytics, operating-system and sharing services supplied by third parties. Their terms and privacy practices may also apply. Map labels, boundaries, traffic, closures, access information and routes can be wrong or out of date.

Links and user references to third-party services do not amount to endorsement. We are not responsible for third-party services outside our reasonable control, but this does not affect any responsibility we have under applicable consumer law.

Changes, availability and updates

We may update the Service to add features, improve safety, maintain compatibility, meet legal requirements or protect users. Features can vary by device, region, account or release stage. We do not guarantee uninterrupted or error-free availability.

We will give reasonable notice of material adverse changes where required. You may stop using the Service and delete your account if you do not accept a change. Security or legal changes may need to take effect immediately.

Suspension, termination and deletion

You may stop using Schpin at any time and request account deletion through available account controls. We may restrict or terminate access where reasonably necessary because of a serious or repeated breach, safety risk, fraud, abuse, legal obligation, security threat or discontinuation of the Service.

Where appropriate, we will explain the reason and provide a reasonable opportunity to appeal. Some information may remain for backups, fraud prevention, legal claims, regulatory duties or other lawful reasons described in the Privacy Policy.

Liability and consumer rights

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory statutory rights. If you are a UK consumer, the Consumer Rights Act 2015 and other mandatory protections may apply.

Schpin is supplied for personal, non-commercial use. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you accepted these terms, business losses, or losses caused by your unsafe or unlawful conduct, inaccurate user content, failure to follow official road information, unsupported devices, or events outside our reasonable control.

Nothing in Schpin assumes your legal duties as driver or vehicle keeper. A disclaimer does not excuse us from using reasonable care and skill where the law requires it.

Governing law and disputes

These terms are governed by the laws applicable in the United Kingdom jurisdiction where the Schpin operator is established. If you are a consumer resident elsewhere, you also retain any mandatory protections and right to bring proceedings in the courts available to you under the law of your home country.

Please contact support@schpin.app first so we can try to resolve a concern. Nothing in this section prevents either party seeking urgent protective relief or using any statutory dispute process available to them.

General terms

If a court finds part of these terms unenforceable, the remainder continues to apply. Delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganisation or sale provided your rights are not reduced.

These terms, together with the policies expressly referenced, are the agreement between you and us about the Service. They do not create rights for anyone else except where the law says otherwise.
